Child had been driven to suicide by school. Where is the commotion?
Sidney Hatchett, a frail and studious 14 year old boy whose mother, Keisha Davis, says was pushed beyond his limits by relentless bullying in school when he took off his coat on March 3 and jumped into the freezing cold East River to his death before the eyes of his little sister. This death caused by school conditions happened in the wake of (but after the press had stopped talking about) the Nixzmary Brown case.
Search as I have of all the links to major media articles and no one asks in print what the school officials knew about this boy's situation nor if he was known the Administration for Children's Services, the New York City child protective agency.
I find that odd. Do you?

Over the last few days humanitarian aid and truckloads of food supplies have been entering Gaza through the Egyptian crossing, but the Karni crossing has mostly remained closed. As a result, prices have gone up and many families cannot afford the food that is available.
I am very please to tell you that Firedoll Foundation has generously offered to match every additional contribution up to $3,000.
If you’ve already made a gift, I am deeply grateful. If you haven’t given yet, or if you are able to give again, please do so now, so that we can take advantage of this opportunity to double your gift now and raise an additional $6,000 to feed children in Gaza.

U.S. opposes depositions in AIPAC case
The U.S. government opposes allowing testimony from Israeli officials at the classified information trial of two former AIPAC staffers.
Lawyers for Steven Rosen, the pro-Israel lobby’s former foreign policy director, and Keith Weissman, its former Iran analyst, asked the court in a motion to be considered Friday to allow three Israeli diplomats to be deposed in the case. The defense wants the Israeli depositions because they will assert that Rosen and Weissman never acted as Israeli agents.
The government opposes the depositions as “irrelevant” because it’s not alleging that Rosen and Weissman acted as Israeli agents, but simply that they conspired to receive and transmit classified information.
Wanted Missing College Students
Maybe you had to drop out of school for a little (or long) while, maybe you were able to stay in school by taking less classes so you could work extra hours to make up for lost tuition assistance, or maybe you just got convicted and don't really know what's going to happen with the future of your education.
Quality vs. Quantity
Also as a person born Jewish I feel a strong sense of outrage at what Jews are doing to Palestinians and I'll be frank, I feel estranged from "my people" and don't live or work among them. I have written and posted other people's writings that I feel strengthen the Palestinian cause. So I strain again to get you to read my blog.
My work has reinforced also my alienation from white America as I see and feel first hand the damage done by racism and discrimination and see the calloused and brutal approach of Child Welfare and police to poor non white and immigrant families in my city. I seethe with anger that it isn't a matter of concern except in a perverted way when the media decides (about every ten years) to make an issue of something that happens all to commonly - the death of a child supposedly under the watch or even care of the child welfare system.
I think also I have a sense of humor and enjoy things like the differences between men and women and the various attractions permutations and combinations in human life.
I express this and maybe I go overboard at times in all of these things.
So if I've offended anyone (who doesn't deserve it) I apologize to you. I can't expect people who have not seen and experienced what I have to feel like I feel, but I will keep trying to do better and be better.

I put in for retirement
In a worse case scenario I could always go back to taxi driving which I didn't dislike at any rate. I think I can pass the test to become a professional New York City Tour Guide and I don't doubt that I could take HR Block's course later this year and get employment preparing taxes. There is also my burgeoning commercial web site Benjamin Dawgg, and other possibilities. It's not as though I am trying to launch a professional career or get rich.
I have e mailed a memo to my supervisor and manager asking basically that they let me out.
I imagine that later today or in the next few days they'll get back to me.

Tomorrow I have to go to see the Administration for Children's Services first stop disciplinary lawyers. They've leveled a raft of charges against me and this first step is called an "informal hearing."
I'm going to keep still until I see more of what they have in mind for me but I will tell you all that I'm not afraid of these people and I have my own plans on how to deal with this. Someone is fooling with the wrong individual here!

George W. Bush and Dick Cheney, two top outlaws smashing our country's
rule of law and democratic liberties, are testing the American
people's resistance. Every day they are testing. Every day they think
by flaunting the words, "war on terror", they can get Americans to
concede more and more of what makes the United States a
constitutionally-abiding government under the rule of law.
You know what? With not enough exceptions, they are right. Day by day,
we're giving up what our forefathers fought to bequeath us since that
famous Declaration of Independence of 1776. They were determined that
people in this country would not be arrested without charges and
jailed indefinitely, that they would not be tortured, or sent to be
tortured in dictatorial regimes, or deprived of habeas corpus to take
their incarceration to our courts of law, or be snooped on at the whim
of the President and his deputies or that people in faraway lands
would be destroyed in the tens of thousands due to a fabricated
war-invasion-quagmire.
They instituted a constitution so that people would not be jailed
without "probable cause", or be lied to about taking this country and
its soldiers to war, or have shoved aside the checks and balances
represented by American courts and the Congress. All these are being
done by two pro-Vietnam war draft dodgers!
What does all this tell you about all of us out there in the great
United States of America? A giant yawn of "who cares" by citizens,
nearly two-thirds of whom now have turned against these two White
House fabricators in poll after poll regarding the war, the surrender
to Big Business, the gross incompetence in managing taxpayer dollars
and the Katrina disaster.
But listen, the rumble of resistance and opposition is getting louder
and not just from the increasing number of public demonstrations
around the country.
A new Zogby poll reports that 72% of American soldiers serving in Iraq
think the U.S. should get out within the next year, including 58% of
the Marines! Three-quarters of National Guard and Reserve units
support withdrawal within 6 months. Every month, more former
high-ranking military officers, intelligence officials and diplomats
are declaring their opposition to the war.
For a few examples of many: Retired four-star General, Joseph P. Hoar,
who commanded the U.S. forces in the Persian Gulf after the 1991 war,
described the Iraq war as "wrong from the beginning". Similar tough
criticism has come from John Deutch, former head of the CIA, Zbigniew
Brzezinski, national security advisor to President Carter and Brent
Scowcroft, national security advisor to the first President Bush.
Retired General William Odom, former head of the National Security
Agency and security adviser to Ronald Reagan, wrote that the Iraq war
"is serving the interests of Osama bin Laden, the Iranians, and is
fomenting civil war in Iraq." He describes the Iraq war as "the most
strategic foreign policy disaster in U.S. history."
More recently, internal memos of criticism or dissent, Inspector
General reports from Defense the Justice Department, and former
highly-positioned staff within the Bush Administration, like Colonel
Lawrence Wilkerson, chief of staff to Colin Powell, are taking apart
the public relations sheen concocted by the Bush/Cheney/Rumsfeld triad.
Now comes the conservative American Bar Association--400,000
lawyers--whose House of Delegates has overwhelmingly approved a task
force report accusing President Bush, in polite legal language, of
violating both the Constitution and federal law. ABA President Michael
S. Greco sent it to Mr. Bush with a cover letter dated February 13,
2006 (see www.abanet.org/op/domsurv for the full report).
The mass media, which has finally produced many exposes of the Bush
war, ignored the significance of this condemnation by the nation's
largest body of lawyers, written in part by attorneys who have served
in the FBI, CIA and NSA. It should have been page one news.
There comes a tipping point, however, when the opposition of the
establishment, the public opinion of the citizenry, the disgust of the
soldiers--their spreading casualties, diseases and mental traumas -
and the corruption of the large corporate contractors to whom much of
the military's functions have been outsourced, all congeal and
overcome the cowardliness of most members of Congress. Then a surge of
Congressional followers and allies of Rep. John Murtha (D-PA), war
veteran and leading voice against the Bush Iraq policies, will come to
the forefront.
The illegal, disastrous (to both Iraqis and Americans) Iraq war is now
almost three years of quagmire old. The chaos and bloodshed are worsening.
It is time to make the spring of 2006 the tipping point period for
constitutionalism, justice and a sane foreign and national security
policy. More yawns must turn into growls from outside Washington, DC.

The City of The Beloved by Israel Shamir
Penance and Mercy, the three sisters are called Amal, Taura, Tahrir, or Hope,
Revolution, and Liberation. Dressed like ordinary college girls they were
- they would not stick out at Yale or Tel Aviv University. Their books and
CDs are the same ones I saw this morning on my son's shelf. But their smiles,
their wonderful happy smiles and high spirits, are quite out of the ordinary,
considering their circumstances.
Fifty years ago their parents were expelled from their ancestral home in
the South for they weren't Jews, and the sisters were born into a family
of refugees in Halil. They were born one after another, to make up for the
many years of their father's jail term. He was with them but a short while,
as his heart gave up when a settler flung a gas grenade into his sitting
room. The youngest sister, Amal, is at high school, while Tahrir is already
a sophomore at university, studying architecture, the fine art of dressing
thoughts in stone and building homes. Their own home, a modest, three-bedroom
stone house with wide windows, set deep in the vineyards of the valley, is
doomed.
The messengers of doom stood outside staring at the ruins of the neighboring
house, at its flat roof broken at the centre, and at a grey-haired woman
with bright blue eyes who was searching in the vestiges of what was her home
until yesterday.
"Yalla, ufi kvar", screeched a tall Jewish girl, Barbra-or-something,
at the old woman. "Get lost!"
An accompanying army officer was ready to oblige. He repeated the order in
Arabic, and, while the woman climbed up from the crater, told Barbra-or-something
about what the old woman had told him: "Her new leg", he said. "Five thousand
shekels' worth. Over one thousand dollars, bought just a month ago. She used
it for her better occasions, and yesterday, when we demolished her home,
she had on her older limb".
"No, she lost her leg as a child in 1948, when the Old city of Jerusalem
was shelled", the officer answered the unheard question of a tall, imposing
man in an elegant grey suit and a small, head-covering kippa. Meanwhile,
two bulldozers pulled away the remainder of the old lady's home, neatly grabbed
the remains of the vineyard and crushed its purple-red leaves into the mud.
At this time of the year, purple-red covers the hills in Halil Country. It
is the land of vine, separated by Bethlehem to the north from the land of
olive. It is the land of broad terraces, reddish-dry soil, abundant sheep,
rare springs, strong faith, and of vine. Though a few hundred years ago the
local folk gave up their Orthodox Christian religion and embraced Islam,
they still press wine in the millennia-old stone wine presses. In the autumn,
the women of Halil sell their heavy, yellow, sweet grapes, still covered
by field dust, at Damascus Gate, wearing their long black dresses with exquisite
embroidery. When my wife gave birth to our first son, I presented her with
just such a black and purple-red dress sewn over many weeks in a village
near Halil.
Much as I like the vine land and the people of Halil, it is not a place one
visits gladly. As in a Greek tragedy, dreadful doom befalls the city. The
sea monster consumed the virgins of Jaffa in the story of Perseus, the Doom
of Halil slowly eats up the city and its folk. Day after day, a house is
confiscated, a shop torched, a man killed. Now, Halil is the semi-digested
object fishermen used to find in the stomachs of decked sharks. It still
preserves some features of the ancient, proud city of men, but it is half-eaten.
If you ever visited a beautiful, terminally-ill young girl, you know the
feeling.
In normal times, Halil country would be much admired, for it is very much
the Land of the Bible: its people's life-style has not changed much. They
are the same shepherds and wine-growers, and the names of their villages
are replete with memory. The great Palestinian brigand Daud, later King David,
charged protection-money in Maan; the prophet Amos grew up in Tukua; Gad
is buried in Halhul. Halil was called Hebron, later St Abraham, later Halil,
or the Beloved, for it is a stock epithet of Abraham, the great culture hero
of the Middle East. That is the original Judea of kings and prophets: Judean
but (despite some similarity of sound) not Jewish, even quite unconnected
to the Jews of old, who never ventured into this arid province so far south.
The Jewish historian Josephus Flavius did not know of those places; the Jewish
books, Talmud and Mishna, hardly mentioned Hebron and Bethlehem. The Jews
called the land, 'Idumea', and its Judean folk, 'Idumeans'. (In similar vein,
the Jews called the land of Israel 'Samaria', and its Israelites 'Samaritans',
as they wanted to privatize the heritage of the Bible.) The native Judeans,
the people of Halil, did not care: they still worked the same fields and
worshipped at the same shrines as did their ancestors, the heroes of the
Bible.
Most of all, they cherish their Ibrahimiye Mosque, commemorating the Beloved
of God, Ibrahim (or Abraham), the spiritual pathfinder for mankind. This
massive edifice of rusticated stones was built in the uncharted past. The
Crusaders erected a beautiful basilica on the old foundations, and the benevolent
rulers of Cairo and Damascus, Istanbul and Baghdad adorned its walls with
Islamic verses. The Mosque of Halil exudes holiness and grace as the font
of spirit that broke out in the Judean Hills. Yes, that is uniqueness of
the Holy Land: while the Almighty gave oil to our neighbors, He gave the
Halilis bottomless deposits of divine spirit. While oil runs out, the more
spirit is given away, the more of it remains. Probably that is why the enemy
made it so hard to get there.
The Old city of Halil is a dense swarm of medieval houses around the Ibrahimiye
Mosque. The closely built houses leave but few entrances into the maze. These
have been blocked by iron gates and barbed wire, leaving just two openings
for access. The openings are controlled by massive checkpoints. The soldiers
checked our documents again, searched us and let us into the city of the
Beloved-turned-into-the-worst-jail in the Gulag archipelago of Palestine.
My Virgil in this descent to Hell was an unusual man, Jerry Levin from Alabama.
An ex-CNN bureau Chief in Lebanon, he spent almost a year in Hezbollah captivity,
and since then, he has lived in the Old City of Halil with a small team of
Christian Peacemakers. CPT people bring food to the besieged, try to protect
the city's folk and suffer the abuses and violence of the settlers and the
military. Born a Jew, he embraced Christ and cast his lot with the downtrodden
of the Earth.
"Do not make too much of my Lebanese prison", he warned me with a wry smile.
"Every man here can tell you of much longer and harsher jail terms".
Children's eyes watched us from behind iron bars. The streets were empty:
for many months, the natives have not been allowed to tread the paved footpaths
of their city. Eternal curfew was imposed here years ago. The shops were
broken into and torched by looting settlers; the walls bear graffiti in cursive
Hebrew script: 'Kill the Goyim; it is good for the Jews', 'Kahane was right',
'Bless your soul, Dr Goldstein'.
We knocked on the iron door of a house and heard sounds of heavy locks being
removed. The door opened a crack to let us in. We climbed up the narrow staircase
to the roof. The grandiose edifice of the Mosque rises high just two hundred
yards away, but the inhabitants rarely venture out that far. Narrow planks
connect the roofs of the city and allow the besieged Halilis to visit their
neighbors. Their children, like birds, run from roof to roof on planks,
or stare through bars at the street below. The streets were privatized by
the settlers, so they can walk there in complete peace, undisturbed by Gentile
presence. Regularly, the settlers break doors down and attack the citizens,
throw their bedding and chairs through windows and beat them up. That is
why their doors are barred by heavy wooden beams and locks. They can't even
go out and buy food: it has to be brought in by European and American volunteers.
Many escape this unbearable life, leave their homes, vineyards and properties
behind and go into exile. In this half-eaten city, only the strongest remain.
Once, my American friend Michael asked me whether the Palestinians are engaged
in non-violent struggle. In Halil, every day, every hour, every minute of
a Palestinian's life is a non-violent struggle for existence. T'is pity it
is not very successful. Apparently, the monsters need a Perseus to do the
persuading.
We walked out into the open. A settler called to us, peering into the dusk
under the arches above the narrow lane:
"Arabs! Scram!"
A soldier on the corner calmed him: "They aren't Arabs. They are internationals".
"They are even worse", said the settler, an elderly East European Jew. And
he called out in his heavy, accented English: "Go away! You are not wanted
here".
"Neither are you", we responded, and came out to the Mosque. It was surrounded
by three chains of soldiers, mainly recent imports from Ethiopia and Ukraine.
We were checked once and once again, asked where from and why, walked through
metal-finders and thought-controllers, soldiers' watchful eyes upon us, full
of habitual tireless hate, to the huge cenotaph of Abraham. And yet, I was
swept by the aura of holiness coming out of the place, as if my spirit were
uplifted on the great tsunami wave. High. Very high. I do not know whether
a holy place is holy due to the holy man buried there, or, other way around,
they bury holy men in holy places, but certainly it was a holy site.
As I turned around, I saw the settlers who had privatized the spiritual spring.
They wore white prayer shawls with black stripes on their shoulders. They
saw me.
"That is an Arab!" said one.
"No, he is a German".
"No, he is an Arab with an Israeli passport; that is why he looks so arrogant",
said the first.
"You Arab?" asked the second.
"Sure", said I.
"Get out of here, you vermin!" they shouted.
Actually, the settlers do not care much for the Tomb of the Beloved. They
have another grave to worship, that of the mass murderer from Brooklyn, Dr
Goldstein. He achieved glory in the Purim of 1994. Purim is the only merry
feast of the Jewish calendar, the anniversary of a jolly good massacre committed
by their ancestors in Persia some twenty-four hundred years ago, when 75,000
men, women and children, were massacred by the avenging Jews.
In the Purim of 1994, Dr Baruch Goldstein came into the Mosque with two machine
guns and a lot of spare clips. The watchful soldiers would not let us bring
in a nail-file, but they did not stop him. He entered the prayer hall, called
'Merry Purim!' and opened fire. He slaughtered some thirty unarmed worshippers,
until the survivors succeeded in killing the rampaging beast. When they carried
their wounded and dead out of the mosque, the soldiers opened fire and killed
an additional twenty worshippers, calling out 'Merry Purim!' When the news
of the massacre reached the Knesset, the Israeli Parliament, Hanan Porat,
a leader of the Jewish Nationalist Religious Party, blessed the parliamentarians
with "Merry Purim".
Dr Goldstein was buried with much respect and love; his grave became a place
of mass pilgrimage for the settlers and their admirers from Israel, America
and all over the world. Young, plump Jewish maidens come there, lay flowers
and light candles on his tomb. Young Jewish soldiers put their American-made
M-16 rifles on his tombstone and ask for the holy man's assistance and guidance.
Young couples exchange vows, old men say Kaddish for his soul.
After the murder, there were voices in Israel calling to remove the settlers
from Halil. But the Israeli government used it to punish the victims: half
of the Mosque was taken over by the Jews; local worshippers were banned from
venerating the Tomb of Abraham the Beloved of God; the entrances of the Old
City were sealed; dozens of Palestinian homes were confiscated and erased;
the main street of the city was forbidden for Palestinian traffic. There
is but little difference in outcome: whether a Jew kills or is killed, the
Jewish state always uses it as a pretext to steal more land and punish Palestinians.
Still, on Fridays the settlers would go to the Tomb of Abraham, whom they
venerate as Christians and Muslims do, but for a different reason. While
for us, Abraham is the spiritual father, a man who found the way to commune
with God and showed it to mankind; they claim him for a biological ancestor
and justification for the privatization of the holy place. (Adams, the American
of Mark Twain's short story would beat them by claiming direct descent from
Adam.) If they could claim George Washington was a Jew, they would surely
privatize the White House. (On second thoughts, they have done that anyway.)
This perverse reading sits deep in the Jewish psyche, and Natalie, a nice
Israeli journalist who accompanied us, asked me:
"Do local Arabs consider Abraham their ancestor as well?"
"The entire world considers him our spiritual ancestor", I tried to explain
to her the non-biological, spiritual and universal faith of Abraham. I reminded
her that Abraham rejected his father, Muhammad rejected his tribe, and Christ
rejected his brothers' call and said that his brothers-in-spirit are more
important than his brothers-in-flesh, but my words could not make a dent
on the vision she was imbued with.
On Fridays, the settlers rule supreme in the city. The army imposes especially
heavy curfew and does not let a single goy out of his house to blacken the
path of a Jew. The soldiers shoot at kids who dare to play outside. The city
can't breathe until the last Jew disappears into the barbed-wire fenced,
for-Jews-only compound. Halil is a good place to learn of the real Jewish
intentions about how the world is to be run - much better than reading their
hypocritical, saccharine-sweet editorials.
But last Friday was different. After the heavy guard accompanied the settlers
into their compound and was on the way to barracks, they came under guerrilla
fire. The guerrilla fighters did not want to copy the Jewish mass murderer;
they let the worshippers pass in peace to their homes, and only after that
did they opened fire. A Perseus dropped by to visit the monster.
Israeli soldiers are brainwashed to believe in their racial superiority,
in the superiority of their weapons, in the protection of their Supreme Commander
Most High, in the natives' meekness. They were sure the spirit of Halilis
was irredeemably crushed. Arrogant and reckless, they rushed into hot pursuit.
The fighters retreated into a lane between vineyards, and as the enemy soldiers
entered there, they sprung their deadly trap.
The Jihad fighters used the old ruse of weak against strong, first described
by Roman historians, later made into a play, The Horatians and the Curiatians,
by the great German playwright Bertolt Brecht. The two warring Roman clans
of Horatians and Curiatians met on the battlefield. The weaker Horatians
feigned flight, and when their heavily-armed enemies followed them and spread
sparse along the route, they turned back and killed their pursuers, one after
another.
The result was nothing short of a miracle: three Jihad warriors with their
carbines killed twelve heavily armed Jews, among them the chief tormentor
of Halil, Colonel Gauleiter of the city, the Hebron Division Commander. The
fighters could not escape: when they made their noble decision to attack
only soldiers and let the settlers pass in peace, they sealed their own fate.
Still, they proved their spirit is strong, as strong as foundations of their
great shrine.
Often one hears that the Palestinians should act in this or other way. They
should not kill the enemy if the enemy takes off his military uniform and
goes for a holiday. They should be choosy with their targets, as otherwise
it is 'counter-productive'. The Halil ambush proved this to be but pious
nonsense. The attack on the soldiers was the fairest one ever launched against

in the ambush lane.
Thus, it does not matter what the Palestinians do, whether they kill Israeli
children or fight Israeli soldiers, or even if they are being killed by settlers,
they are found guilty anyway, for they did not surrender to the Jews. Those
who surrendered without fight won't forgive them. But the Palestinians of
Halil, these most abused people on earth, know the truth. And that is why
broad, happy smiles stayed on the innocent faces of the three sisters, Hope,
Revolution and Liberation.
The nice Israeli journalist Natalie felt she had to balance her story to
make it acceptable to her editors.
"But what would you say about terrorist acts in Tel Aviv against Israeli
civilians?" she demanded from the girls whose home was to be demolished.

to the question of a German journalist about his feelings for the German

In this city of nasty settlers and brutal soldiers, there was no man as vile
as this Rabbi Wise. The settlers turned life of local people into hell, and
the soldiers protected them, but they did his will, and he brought them billions
of dollars taken from the Americans, and covered for them in corridors of
the Congress. I felt great pity for the Americans, the industrious and generous
folk, sold down the river by their politicians and turned into slaves of
Mordor.

I felt it was impossible to remain a Jew in Halil. Indeed, the Jews who feel
that demonstrating against their government's policies is not enough, are
now doing the unthinkable with greater ease. Thus, Neta Golan, the wonderful
Israeli girl who stayed with besieged Palestinian villagers in Kufr Harith,
chose the faith of Mercy. In the most unexpected way, the vicious Zionist
[anti-]Christian cultists' dream of the Jews coming to Christ on the ruins
of Palestine may yet come true, as ever more Jews who face real, victorious
Judaism in the inferno of Hebron turn away in disgust. The cultists were
right but for the wrong reason: the gathering of Jews in the Holy Land will
bring the good people to light, as they will see this total darkness undisguised
and reject it.
That is why the Intifada is so important: it could be the beginning of universal
world-wide Intifada. It should not stop at the borders of the Holy Land.
I know this thought is foreign to Palestinians. They fight for their villages
and towns, for their equality and freedom to live and worship at their shrines.
For them, if the settlers were to lose their privilege, the problem will
be over. But for Rabbi Wise and his ilk, their slavery and possession of
Palestine is the necessary worldly proof of their achievement, and they won't
let it off lightly. It all comes back to the morality play: Hope of Halil
is but a sister of Liberation of Discourse and of the World Intifada.

DECLINE
It's probably because the brouhaha about children dying on the ACS caseload has been allowed to fade out by Mike Bloomberg and the other media moguls and because my earlier controversial remarks about "Israel" and related matters have been seen by those who want to see them that the circulation of this blog is going down.
A freelancer has interviewed me and gone pretty thoroughly over this blog. Now that Nixzmary is not hot and almost forgot, I don't know if I will sell. Let's see.

Court Rules that Marilyn Monroe Photos Belong to the World
LOS ANGELES, CA, June 29, 2005 —Yesterday, in United States District Court in Orange County, Judge Gary L. Taylor entered judgment in favor of VNU Business Media, Inc. in a copyright infringement suit over a biography of Marilyn Monroe that VNU published in 2001. The plaintiff, Milton H. Greene Archives, Inc., had sued the book publisher for copyright infringement, claiming ownership of photographs used to publicize Bus Stop and The Prince and the Showgirl, films starring Ms. Monroe in the 1950s. In granting a summary judgment motion filed by VNU, the court ruled that the plaintiff, a company owned by the son of the celebrity photographer, did not own valid copyrights in the photos because they were originally published without copyright notice at the time of the theatrical release of the films and thus fell into the public domain.
“We are extremely pleased with the result,” said Andrew J. Thomas, a Davis Wright Tremaine attorney who defended VNU in this suit. “The judge took a great deal of time and care considering both sides’ claims, but eventually sided with VNU due to the extensive historical documentation we presented.”
The suit arose from the use of seven photos of Ms. Monroe in a book that chronicled her film career titled Blonde Heat, authored by Richard Buskin and published by VNU's Watson-Guptill Publications division. The photographs were publicity shots used to promote two films in 1956 and 1957, Bus Stop and The Prince and the Showgirl , which were produced through a partnership with Marilyn Monroe and photographer Milton H. Greene. Through archive research and expert testimony, VNU was able to show that all of the photographs at issue either were published in contemporaneous newspaper advertisements and articles, or were included in the film studios' promotional materials, called “press books”, that were distributed to theater operators nationwide to assist in film marketing. Because the photographs were widely distributed without proper copyright notices on them, the photographs fell into the public domain under the copyright law in effect at the time.

Civil Service Paper Allows District Attorney to Trash ACS Workers


The Civil Service Chief Leader fashions itself a voice for unionized Civil Service Employees. They gave space to that "great labor leader" Brooklyn District Attorney Charles "Joe" Hynes to ignorantly trash the mostly Black mostly female entirely disrespected and underpaid child abuse investigators of ACS.
Hynes said that the caseworkers need to act more like cops. Great advice to underpaid women who are sent alone by public transportation to confront any and all types of anti social and psychotic individual with a clipboard a pen and a plastic ID card. And to top it off these workers will be abandoned by their management at the whim of media or any complainant.
I got an opportunity to briefly and slightly correct this matter with a letter to the editor>

Unfair Comparison
To the Editor:
Lest we forget, the NYPD Special Victims Squad was at Nixzmary Brown's school. What were they doing there? We are told that they were providing security to the Caseworkers because one of the Detectives personally knew one of the Caseworkers. What sort of NYPD attitude is that?
Comparing cops' situation to Administration for Children's Services staff caseloads, appointments, and refusal of management to authorize overtime is like comparing apples and oranges. So is comparing a female Caseworker confronting a psycho alone to two cops with badges, guns, walkie-talkies and the support of their management and the media.
The Child Protective Services Division is collapsing under this crisis. That's something that needs to be addressed, and now, not in three months.

Black NYPD Captain Eric Adams, a long time critic of certain NYPD practices and founder of the organization 100 BLACKS IN LAW ENFORCEMENT WHO CARE had put in his retirement papers to free himself to run for political office. Some spiteful people wanted to impede the good Captain and launched an anti free speech disciplinary action against him which is on appeal now but so far cost him 45 days pay and a delay in his retirement.
What the Captain had done was appear on a television program and say the following words about an anti terror mobilization in which he contends the cops on the ground were not told of what the specific threat supposedly was:
"While the cops were on post trying to protect the subway system, they were never given the specific information that would have assisted them in trying to protect the system,"
Mr. Adams, who plans to run in Brooklyn for a State Senate seat after he retires, said that NYPD anti-terrorism officials were unaware that the threat involved carrying a bomb onto the subway in a baby stroller.
I'm sure Captain Adams is not happy about this disciplinary action but I also would wager he'd agree that it's worth 45 days pay to tell the truth.

Call it fiction, or say I'm nuts....
Dear Mr. Commissioner:
I am writing this letter to you because I have confidence in the rightness of what I am going to tell you, even though the last time I communicated directly to you regarding case practice in ECS I had to undergo an attempt at retaliation that failed.
As you may know, a one month old infant died in New York City last night. I was assigned to investigate this matter prior to the acceptance by the SCR of any report against the parents.
I spoke with the detective on the case who told me that he did not suspect child abuse or neglect at this time. He told me that the infant had been carried by the now subject mother in an ordinary baby carrier. He told me that he could not make a determination regarding crime prior to the results of the Medical Examiner's investigation. He did tell me that the home is in deplorable condition. (This is not mentioned in the Oral Report that the SCR was generating at perhaps the very moment I was getting into a car to go to the parent's home.)
My visit to the parent's home, at 2:21 AM, is described in my case notes. Basically the now subject father wanted ACS to return to his home at a more conventional hour. He stated that he and his wife are bereaved. He said that the surviving one year old sibling is in the home of a neighbor. He said he did not want to wake up that neighbor's family and that the child would be returned to his apartment in the morning.
I decided not to push, bully or coerce this father into allowing us into his home at 2:30 in the morning nor to attempt to force the awakening of the neighbor's family.
I want to bring up another matter. The (*person) whose report was taken has told ACS that the report does not accurately reflect his words. He did not say that the child was being carried in a "backpack." More than once I have spoken with reporters who tell me that the ORT being described to them does not reflect the information they reported, and I can say that this has happened even tome in reports I have called in carefully going over the facts with the SCR worker. At times the information gathered by us from reporters would point to a lack of any real allegations, yet we pursue these matters, prying into the lives of people who have not been truly and factually even accused of doing anything wrong, sometimes calling them and ringing their door bells sometimes at very unconventional hours as well.
I initially objected to the assignment to go to this family’s home in the stark hours of early morning. I feel this is a brutish and heartless act, needlessly heartless at that, and in fact I question being assigned to investigate the family or ring their doorbell without a report.
I can recall another instance in which a child died xxxxx xxxxxx and a report was made only accusing this family of leaving the deceased child’s siblings unattended in a hospital parking lot. I was dispatched to the family’s home and learned that the children in question were not unattended. (Such an investigation on the day a parent’s child has died!) When I called back to the IRT coordinator he wanted me to return to the home and question the family about the death that had been investigated by police and found not to be homicide and after the hospital that pronounced the child dead had not reported any neglect or abuse connected to the death itself.
In still another instance another worker told a manager that the worker suspected that a reporter was mentally disturbed. I was assigned to assist on the matter, to ring the doorbell of the reporter at around three in the morning to assess his mental state!
In still another case I was ordered to “tell the parents” of a child who just had died on the day of this death that the “had to bring the other children to the hospital right now.” I’d hope not to see those days return.
I believe in the rule of law. When lawmakers, law enforcers and government officials habitually do not abide by law then the ideas that underpin our Declaration of Independence come into play. Beyond the law and rule of law (investigation without report, investigation of reporters) there is a matter of common decency in all of this. Our office is called “Emergency Children’s Services” I think for a reason. We are conceived as an arm of Child Protection that intervenes in emergencies. It is a matter of decency if not of law that people are not to be disturbed in their abodes by the government at unreasonable times or for reasons that lack reason.
One cold February morning around four years ago I removed four little children from their homes at around four in the morning without court order and for no reason a normal person would accept, other than the old cliché “I was only following orders.” I wrote a memo to my director who thanked me for bringing the matter to his attention. A few months after this the manager retired, some say under duress. This action was ordered and insisted upon after my co worker and I told the supervisor from the home itself that there was no safety emergency in this home – and I promised myself that I would never again be the instrument of such thoughtless brutality.
I’m almost 60 years old and it is too late for me to change much. I have these hang ups about decency, respect for others and lawfulness of government actions that help make me into a misfit where I work, but it is too late for me to find another job. Maybe it is not too late for the place where I work to change.

During this meeting, the CPM will review with you our mission versus the mission of the police, our role, our mandates, our case practice guide, and our responsibility to act effectively upon all calls requiring a child abuse/neglect investigation and/or immediate preventive services. The CPM will also discuss with you our Instant Response and High Risk protocol, which requires an immediate face-to-face response on all cases identified as high risk by the SCR. This includes all IRT cases (i.e. fatalities, sexual abuse, serious injuries, severe neglect/abuse reports, etc.) There is also a fatality protocol, which requires the immediate response on all reported fatality situations and the submission of a 24-hour fatality report to the State, which the CPM will review with you. In addition, I want to emphasize that Children’s Services is a fully operational 24-hour per day agency. We operate this way because we live in a diverse and multicultural city. Some of our citizens function during the day, while others (like ECS employees) function at night. We cannot in good faith and with good conscience fully protect our children if we decided that we should not conduct home visits during certain hours.
Lastly, I want you to know that your comments are always appreciated, but you must follow the Chain of Command, as required by the Agency’s “Employee Code of Conduct,” to address all work related issues. Conferencing with you about this matter and/or directing you to follow the code of conduct is not “retaliation.” Since it seems that you are lacking clarity in this matter, your CPM will review the code of conduct with you as well. Frozen Scandal
Age of Frozen Scandal. Journalist Mark Danner speaks to Tom Dispatch's Tom Engelhardt:
Danner: The icebergs are floating by. I've used the phrase to indicate that a process of scandal we've come to know, with an expected series of steps, has come to an end. Before, you had, as step one, revelation of wrongdoing by the press, usually with the help of leaks from within an administration. Step two would be an investigation which the courts, often allied with Congress, would conduct, usually in public, that would give you an official version of events. We saw this with Watergate, Iran-Contra, and others. And finally, step three would be expiation -- the courts, Congress, impose punishment which allows society to return to some kind of state of grace in which the notion is, look we've corrected the wrongdoing, we can now go on. With this administration, we've got revelation of torture, of illegal eavesdropping, of domestic spying, of all kinds of abuses when it comes to arrest of domestic aliens, of inflated and false weapons of mass destruction claims before the war; of cronyism and corruption in Iraq on a vast scale. You could go on. But no official investigation follows.
TD: You get revelation and repetition.
Danner: Yes, R and R. It's been three years since the invasion and occupation of Iraq and there's been no official investigation of how the administration made use of intelligence to suggest that the intelligence agencies were certain Iraq had weapons of mass destruction. Now, the consequence of this is that we live with the knowledge of these scandals, published in newspapers, magazines, books, but we get no official acknowledgement of wrongdoing and no punishment. Perhaps in the end a handful of people will be punished… [...]
That leads me to a conclusion I came to then: that in many stories it's not the information, it's the politics. It's not that we were lacking information. It's that, when that information came out, it was denied and those in power were able to impose their view of reality. Political power decided what reality was, despite clear information to the contrary. When I look at our time I see that phenomenon writ large. It's gone way beyond a massacre in a relatively obscure Central American country. It's gone to policies and statements that led the United States to invade a country that had not attacked us, to torture prisoners and deny we're doing it even when clear evidence says that we are, to domestic spying in which the government is clearly breaking the law and the President declares that he will continue to do so. In all these cases, it's not the information, it's the politics. This is a hard thing for journalists to admit because the model of journalistic behavior in our era is Watergate. It's very hard for journalists to come to grips with the reality that wrongdoing can indeed be exposed, and continue to be exposed again and again with no result, in a kind of tortuous eternal return. I am almost speechless about this book because all the idiocy recounted in the book reminds me of idocy in my office and reminds me of why I prefer the people I meet when I am investigationg their families to the people I work for.
You have to read that book and see for yourself the racism, the inertia, and the idiocy of it all, legal system included.

At age 12, Shirley Wilder ran away from an abusive home
and landed in New York City's foster-care system. By
age 13, she was named the plaintiff in a class-action
lawsuit that challenged the city's 150-year-old system
as unconstitutional. At 14, Shirley gave birth to a son,
Lamont, who was soon swept up in the same system. This
absorbing account by New York Times reporter Nina Bernstein
follows the threads of the tragic lives of Shirley and Lamont
Wilder and the lawsuit that bears their name. In the

the First and Fourteenth Amendments for giving private
religious agencies control of publicly financed
foster-care beds. These mostly Catholic and Jewish
agencies gave preference to white Catholic and Jewish
children, while the growing numbers of black and Protestant
children were sent to inappropriate institutions that
left them with more problems than they had when they
came. Such was the fate of Shirley, who, for lack of
anywhere else to go, was placed in Hudson, a state
reformatory for delinquents with no treatment services
for abandoned or abused children. Hudson "looked
like a camp from the outside and was unmistakably
a prison within." There was rampant violence and
sexual abuse, and girls were regularly punished by
being put in "the hole," a 5-by-8-foot cell with no
windows, furniture, or heat, which Shirley would
later testify was like "Winter. Winter--all year
round." But a case that named state and city officials,
77 voluntary agencies and their directors, and 84
individual defendants including nuns, rabbis, and
clergymen, and that threatened to pit blacks and J
ews against each other, was a case destined to enter
a legal wilderness of avoidance and delay.
Shirley and Lamont's unforgettable stories reveal
the deep fault lines in a system that often does
more harm than good. While reforms come and go with
little success, Bernstein makes clear that the child
welfare system will never really change until there is
a coming to terms with the system's place as

poverty, of civil rights and social change, is compelling

Odd coincidence. On a day when I spent the lunch hour brushing up on the Israeli spy scandal -- fake art students casing DEA offices; crooked "furniture mover" scamsters who danced a jig while the Twin Towers fell -- this report by Wayne Madsen bounced into my email: EXCLUSIVE REPORT: THE DEMISE OF GLOBAL COMMUNICATIONS SECURITY The Neo-Cons' Unfettered Access to America's Secrets. Now, one must be doubly careful here. First, I'm well aware that Madsen somewhat injured his rep during the course of his Five Star Trust reports. I also happen to be of the opinion that a writer may take up temporary quarters in the doghouse without having to move there permanently. Second, I'm also aware that the Israeli spy scandal represents rich territory for the anti-Semites. Sorry, but the ravings of racists should not dissuade us from examining what should be considered a straightforward espionage case. Israel is nothing more or less than one government among others -- and as the ghost of I.F. Stone reminds us, no government is to be trusted.....

The Starboard Side
Justin Raimondo is one of the most powerful political writers today. His site, AntiWar has been stalwart in its opposition to the Iraq War. In his last two articles, he has blasted critics of the Dubai Ports World deal, accusing them of being anti-Muslim and anti-Arab. His views deserve to be excerpted:

I have a suspicion that the current ruckus reflects the economic interests of not only the unions, but also Eller & Company, the Miami-based business formerly a partner of Peninsular that is now suing for being forced into an "involuntary" partnership with those feelthy Ay-rabs. The suit raises the security canard, and one wonders what sort of economic interests the smear campaign is intended to mask. A press conference held Tuesday decrying the ports deal was held in Miami, and the Miami-based nature of the smear campaign tells me that something is afoot in the land of the hanging chad. In any controversy like this, the first rule is to follow the money, and this AP report hints at the stakes:
"The lawsuit represents the earliest skirmish over lucrative contracts among the six major U.S. ports where Peninsular and Oriental runs major commercial operations: New York, New Jersey, Baltimore, New Orleans, Miami, and Philadelphia. The lawsuit was filed moments before the court closed Friday and disclosed late Saturday by people working on the case."
It wouldn't be the first time a corporate entity tried to take out the competition by raising a bogus threat to "national security." Led by a disparate coalition of mindless opportunists, anti-Arab racists, and warmongering politicians, an effort to scare the American public into making a few ruthless "entrepreneurs" obscenely rich by giving them a virtual monopoly on America's port facilities shows every sign of apparent success. The victors will be laughing all the way to the bank.
